Welcome to Bespoke Network Solutions ("we," "us," or "our"). These Terms and Conditions ("Terms") govern the provision of our CCTV and Wi-Fi network installation services, including related equipment and support (collectively, the "Services"), to you, our residential or commercial client ("you" or "Client"). By engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By requesting, scheduling, or receiving our Services, you confirm that you have the legal capacity to enter into these Terms. If you are engaging us on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.
2. Scope of Services
- Services Provided: We install, configure, and test both Broadband networks and CCTV systems for residential and commercial properties as agreed in a written quote, contract, or work order ("Service Agreement").
- Equipment: We may supply camera’s, routers, cabling, or other hardware ("Equipment") as specified in the Service Agreement/ Quote. Any Equipment provided remains our property until fully paid for.
- Limitations: Services are limited to the scope outlined in the Service Agreement/ Quote. Additional work (e.g., repairs due to pre-existing issues or changes requested mid-project) may incur extra fees, subject to your approval.
3. Client Responsibilities
You agree to:
- Provide accurate information about your property, network needs, and any relevant conditions (e.g., structural limitations, existing wiring).
- Grant us reasonable access to your property during agreed-upon times for installation, inspection, or maintenance.
- Ensure your property is safe and suitable for our technicians to perform the Services (e.g., clear access, no hazardous conditions).
- Obtain any necessary permits, consents, or landlord approvals before work begins, unless we agree otherwise in writing.
- Maintain and avoid tampering with installed Equipment.
4. Payments and Fees
- Pricing: Fees for Services and Equipment are outlined in the Service Agreement or quote. All prices are in British pounds (£) and exclude applicable taxes unless stated.
- Deposits: A deposit of [e.g., 50%] may be required before work begins, with the balance due upon completion or per the payment schedule in the Service Agreement.
- Payment Methods: Payments are accepted via bank transfer, cash or Cheque
- Late Payments: Overdue payments may incur a late fee of which will have been detailed in the Service Agreement or Quote.
- Changes: Any changes to the scope of work may result in adjusted fees, which will be communicated and agreed upon in advance.
5. Installation and Completion
- Scheduling: We will schedule installation at a mutually agreed time. Delays caused by you (e.g., lack of access, unprepared site) may result in additional fees or rescheduling.
- Completion: Services are considered complete when the system is installed, tested, and operational as per the Service Agreement/ Quote, subject to your reasonable satisfaction.
- Delays: We are not liable for delays due to factors beyond our control (e.g., weather, supply chain issues, or third-party delays).
6. Equipment and Warranties
Ownership: Equipment remains our property until fully paid. You agree not to sell, modify, or remove it until payment is complete.
Warranties:
- Equipment: We pass through manufacturer warranties for Equipment (typically 1-2 years). Any defects should be reported to us promptly for processing under the manufacturer’s terms.
- Installation: We warrant our installation work against defects in workmanship for [e.g., 90 days] from completion. This does not cover damage caused by misuse, tampering, or external factors (e.g., power surges, vandalism).
- Exclusions: Warranties do not cover issues arising from improper use, unauthorised modifications, or failure to follow maintenance instructions.
- Repairs: post-warranty or non-warranty repairs may incur additional fees, subject to a separate agreement.
7. Data and Privacy
CCTV Data: You are responsible for managing and securing any footage or data recorded by CCTV systems, including compliance with applicable privacy laws unless stated in the service agreement. (e.g., notifying others of surveillance, data storage limits). We may maintain access to remotely monitor the network allowing us to remotely resolve any issues that occur efficiently, unless agreed otherwise.
Broadband Security: We configure Wi-Fi networks with standard security protocols, but you are responsible for maintaining network security (e.g., updating passwords, monitoring usage). Our Data Practices: Any personal information we collect (e.g., contact details, property information) will be kept on file confidentially.
8. Limitation of Liability
To the fullest extent permitted by law:
- Our Services and Equipment are provided "as is" except for the warranties outlined above.
- We are not liable for indirect, incidental, or consequential damages (e.g., loss of data, business interruption, property damage) arising from the miss use, or failure of our Services or Equipment.
- We are not responsible for third-party services (e.g., internet providers, cloud storage) or issues beyond our control (e.g., power outages, network interference).
- Should we be proven to be negligent, our public liability insurance carries an indemnity limit if 10 million pounds.
9. Indemnity
You agree to indemnify and us for any claims, losses, or damages (including legal fees) arising from:
- Any unsafe or unlawful conditions at your property.
10. Termination
- By You: You may cancel Services before work begins, subject to any deposit refund terms in the Service Agreement or if equipment has already been ordered. Cancellations after work starts may incur fees for work performed.
- By Us: We may suspend or terminate Services if you fail to make payments, violate these Terms, or deny us reasonable access to your property.
- Effect of Termination: Upon termination, you must pay for all Services and Equipment provided up to that point.
11. Governing Law and Disputes
These Terms are governed by Jersey law. Any disputes will be resolved in the courts of Jersey. We encourage resolving issues directly with us first.
12. Force Majeure
We are not liable for failure to perform Services due to events beyond our control, including but not limited to natural disasters, strikes, government restrictions, and Internet service providers.
13. Changes to Terms
We may update these Terms at our discretion. The latest version will be posted on our website www.bnsci.co.uk with an updated "Last Updated" date. Your continued engagement with our Services constitutes acceptance of the revised Terms.
